Ex-Revocation Drummer Wins $30,000 Settlement from Oklahoma City Police

Then-Revocation drummer Phil Dubois-Coyne — one of our absolute favorite drummers in metalsuffered a broken arm while on the Mayhem tour in 2014. The details surrounding the incident were never publicly released, and it would be the end of Phil’s time with the band: Alex Rudinger (ex-The Faceless) and Jon “Charn” Rice (Job For a Cowboy) filled in for him on the band’s subsequent tours, with Ash Pearson eventually taking over behind the kit for good.

Now we know a bit more about what happened: Dubois-Coyne’s arm was broken by the police!

Oklahoma City-based news site NewsOK.com is reporting that Dubois-Coyne has reached a $30,000 settlement with the city and three police officers involved in the incident. He filed the lawsuit in 2016, alleging use of excessive force and false arrest. A trial had been set for January 2018, but both parties agreed to the settlement on December 15th.

Dubois-Coyne and another unidentified performer were allegedly chanting, “Fuck the police” at the Mayhem Fest after-party in Oklahoma City after the other performer was being arrested and taken away. The officers were allegedly trying to help an assault victim, whose identity has also not been released. Dubois-Coyne’s attorney argued he was exercising his first ammendment rights to chant, while the prosecution claimed the arrest was lawful and the use of force was necessary given the situation.

Score one for the good guys! The full details surrounding this incident still aren’t known, but no amount of verbal taunting should justify the use of force by a police officer that would result in a broken bone.

Dubois-Coyne’s attorney revealed that Dubois-Coyne has a bit of a deformity from the injury, but opted out of corrective surgery in order to avoid a potential side effect of nerve damage. Phil has been serving as drum tech for Cannibal Corpse for the past couple of years, teased a new band called Huffpit earlier this year, and has been generally active on Instagram with myriad drum videos ever since parting ways with Revocation.
