Decapitated are Suing Earache Records for Unpaid Royalties
Decapitated have released six records over their twenty years as a band, the first four of them through Earache Records, once a powerhouse in the worldwide metal scene but quite diminished in recent years. But it seems as if Earache hasn’t treated the Polish death metallers so well of late, as the band is alleging that the label hasn’t paid them royalties since their record deal ended ten years ago. And they’re taking Earache to court over it.
Decapitated just released the following statement to MetalSucks:
In 1999 when we signed with Earache we were just teenagers..we thought it was going to be an amazing opportunity, signing to a world famous metal label.
Thanks to the support from our fans we were able to forge a great career from Decapitated and we appreciate every person who has bought our records…unfortunately, we have not seen a penny from owed royalties from Earache.
Due to on-going disputes with the label regarding these unpaid royalties and contested breaches of contract we find ourselves in a position whereby we need to pursue legal action to rectify already very overdue issues, not only to get justice for the band but more importantly for Vitek’s widow and daughter and Covan and his carers.

Court battles are expensive, so Decapitated have launched a limited edition hoodie and t-shirt line to help defray the costs.
It’s worth noting that there are two sides to every story and they’re both always worth hearing. As of yet Earache has not commented on the situation, but we’ll let you know when they do.
